TERMS AND CONDITIONS

1. Introduction

These Terms and Conditions (“Agreement”) govern the relationship between you (hereinafter referred to as “you” or “the Client”) and Spyrakis Medical Tourism Values, a company operating in Greece as a medical tourism facilitator (hereinafter referred to as “we,” “us,” or “the Company”).

By accessing our website and/or using our services, you acknowledge that you have read, understood, and agreed to be legally bound by this Agreement.


2. Scope of Services

The Company provides facilitation services for various medical treatments in Greece, including but not limited to:

  • Aesthetic and plastic surgery
  • Dental care and oral surgery
  • Robotic gynecological surgery
  • Fertility treatments (In Vitro Fertilization – IVF)
  • Diagnostic evaluations and health check-ups
  • Rehabilitative care

Our services may include medical consultations and referrals, coordination with certified doctors and medical centers in Greece, Europe, and the United States, as well as assistance with travel arrangements, accommodation, translation and interpretation, and post-treatment support.

Note: We do not provide direct medical care. All clinical decisions and medical acts are performed exclusively by licensed healthcare professionals and medical institutions in Greece.


3. No Medical Advice – Disclaimer of Liability

We do not provide medical diagnoses or treatments. Such services are offered solely by legally licensed physicians in Greece.

Spyrakis Medical Tourism Values bears no responsibility for outcomes, success rates, complications, side effects, or any act of medical negligence or omission.

Clients are strongly advised to consult their personal physician before undergoing any medical treatment abroad.


4. Client Obligations and Responsibilities

You must provide complete, accurate, and up-to-date medical information and documentation, answer truthfully all health-related questions, and follow pre- and post-operative instructions given by your doctor.

You are also responsible for holding adequate travel and medical insurance coverage.

Providing false or misleading information may endanger your safety and treatment outcomes and constitutes valid grounds for the Company to cancel this Agreement.


5. Liability and Limitations

The treating doctor enters into a separate agreement with the Client for the provision of medical services. The Company acts solely as a facilitator and is not a party to that relationship.

Our staff members are not medical professionals and do not provide medical advice. The Company assumes no responsibility for treatments or services rendered by third parties or for any related medical claims.

We shall not be liable for damages arising from non-compliance with medical instructions or treatment failure. Any refund or price adjustment due to unsuccessful outcomes must be discussed directly with the treating doctor.

The Company is not liable for service interruptions caused by force majeure events (e.g., power outages, strikes, severe weather conditions).


6. Medical Evaluation and Treatment

All treatments are carried out only after an independent medical assessment by the relevant physician.

Treatment plans and costs may be adjusted following an in-person examination and diagnostic results.

The healthcare provider reserves the right to modify or decline treatment if contraindications or changes in the patient’s condition are identified.


7. Financial Terms

An initial non-binding cost estimate is provided based on the information you submit.
The final cost is confirmed after direct communication with the doctor.

All payment terms and deposit requirements are provided in writing.

You are solely responsible for all medical, travel, and accommodation expenses unless otherwise agreed in writing.

Additional tests or procedures deemed necessary by the doctor may incur extra charges.
Extended hospital stays beyond the scheduled period will be billed separately.

Failure to meet financial obligations constitutes a breach of this Agreement and may result in service termination.


8. Cancellation and Refund Policy

a. Cancellation by the Client

You may request to cancel your booking or agreement only in writing, subject to the following conditions:

  • Up to 30 days before the scheduled start date: 80% refund (20% retained for administrative costs).
  • Up to 15 days before: 50% refund.
  • Less than 15 days before: No refund, unless cancellation is due to force majeure (e.g., serious illness or travel restrictions).
  • Non-refundable amounts charged by partner clinics, hotels, or third parties are not covered by the Company.

b. Cancellation by the Company

The Company reserves the right to cancel this Agreement in the following (indicative) cases:

  • The client fails to comply with medical or travel requirements necessary for safety or program success.
  • Delayed or incomplete payment.
  • Misleading statements regarding medical history or legal status.
  • Conflicts of interest or legal restrictions that render cooperation impossible (e.g., entry bans, export prohibitions of biological material).

In such cases, the Company may terminate the cooperation by written notice without any further obligation to refund.

c. Force Majeure

Neither party shall be held liable for delays or non-performance due to events beyond their control, such as:

  • Natural disasters, pandemics, wars, government restrictions, or strikes.

In such events, both parties shall make reasonable efforts to reschedule rather than cancel the services.

d. Communication and Refund Process

All cancellation requests must be submitted via email to the Company’s official contact address.
Approved refunds will be processed within 30 business days from the confirmation of cancellation.

9. Travel and Accommodation Disclaimer

While we assist with hotel bookings, transportation, and travel arrangements, Spyrakis Medical Tourism Values shall not be held responsible for any delays, cancellations, or issues caused by third parties (such as airlines, hotels, or taxi services).

We are also not liable for delays or non-performance arising from events of force majeure, including but not limited to natural disasters, pandemics, acts of war, governmental measures, or labor strikes.


10. Data Protection and Confidentiality

Your personal and medical data are protected in accordance with the EU General Data Protection Regulation (GDPR).

Information is shared only with your explicit consent and exclusively with physicians and partners involved in your treatment.

Please note that data transmission over the internet is not entirely secure; by using our services, you acknowledge and accept this inherent risk and release the Company from liability related to data loss or breach.

To submit medical data, you must be of legal age or have the consent of a guardian.

The Company uses Salesforce CRM for client management, in full compliance with international security standards (GDPR, ISO 27001). All client information is treated as confidential and will not be disclosed without the client’s consent.


11. Insurance

We strongly recommend that clients obtain private travel and medical insurance.
The Company bears no responsibility for medical complications, additional costs, or unforeseen events.

Upon request and for an additional fee, the Company may assist in arranging travel or medical insurance coverage.


12. Limitation of Liability

To the maximum extent permitted under Greek and European law, Spyrakis Medical Tourism Values shall not be liable for:

  • Any acts or omissions of physicians or third-party providers
  • Direct or indirect damages
  • Losses arising from travel interruptions or force majeure events
  • Changes or delays in treatment schedules

13. Complaints – Negative Reviews – Company’s Right to Compensation

The Client agrees to first address any complaint or dissatisfaction directly to the Company in good faith, to allow for an amicable resolution.

Reviews and public feedback must relate only to services provided by Spyrakis Medical Tourism Values, and not by any third party (such as physicians or travel agencies).

The Company reserves the right to seek compensation for any false, malicious, or defamatory statements that cause moral or financial damage.

The publication of false or defamatory comments may constitute civil and/or criminal liability under applicable law.


14. Links to Third-Party Websites

This website may contain links to third-party websites for research or informational purposes.

Use of such websites is governed by their own terms and conditions.
Accessing any third-party site through our website is at your own risk.

Spyrakis Medical Tourism Values is not responsible for the accuracy of information, opinions, or data presented on external websites, nor for the security of links or communications with those sites.

The Company reserves the right to remove or terminate any third-party link at any time.
The presence of a link does not imply endorsement, authorization, or recommendation by the Company.

Links are provided purely for the convenience of users.


15. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with Greek law.
Any disputes arising out of or in connection with this Agreement shall fall under the exclusive jurisdiction of the courts of Athens, Greece.


16. Consent and Acknowledgment

By using our services, you acknowledge and accept the inherent risks of medical tourism, confirm that you have read and agreed to these Terms and Conditions, and grant your consent for the coordination of your medical treatment in Greece.


17. Special Terms by Type of Treatment

17.1 In Vitro Fertilization (IVF)

All IVF services are subject to Greek Law 3305/2005, which regulates age limits and consent.

A signed informed consent form from both partners is required.

Genetic testing procedures may be subject to approval by the National Authority for Assisted Reproduction.

17.2 Aesthetic and Plastic Surgery

Results vary among patients and are not guaranteed.

Pre-operative photographs and signed consent forms are required.

Any revision surgeries may involve additional costs.

17.3 Dental Restorations

Prices are determined following X-rays and clinical evaluation and may change accordingly.
Patients must comply with follow-up appointments, especially for dental implants.

17.4 Patients Under 18

Written consent from both parents or legal guardians is mandatory, as well as the presence of an adult escort.

No treatment will be performed without full parental consent.

17.5 Mental Health and Cognitive Capacity

A psychiatric evaluation may be required.

Services may be declined if the treating doctor deems it necessary for patient safety.

17.6 Pre- and Post-Operative Records

Accurate and complete records must be provided.

Failure to comply or the submission of incomplete or false information may result in treatment cancellation without refund.

17.7 Use of Photos and Testimonials (Optional)

With express consent, anonymous photos or videos may be used for educational or promotional purposes.

Consent may be withdrawn at any time.


18. Validity and Modification of Terms

These Terms remain valid until modified or terminated.

Any updates will be published on our website and will take effect 14 days after publication, unless immediate enforcement is required by law.

Continued use of our services implies acceptance of any updated terms.

If any clause is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.

The invalid part will be applied to the maximum extent permitted or replaced by an equivalent provision.


19. Entire Agreement

This Agreement constitutes the entire and exclusive understanding between you and Spyrakis Medical Tourism Values concerning the use of our website and services.
Failure by the Company to enforce any right shall not constitute a waiver of that right.
